GJP successfully secured the removal of an agricultural occupancy condition and a planning obligation which prevented the severance of the land associated with the agricultural operation from the dwelling. We were able to demonstrate that the agricultural occupancy condition and planning obligation had been placed on the property in error from a Planning Permission dating back to 1992. The landowner is now able to market and sell the property on the open market and was able to retain the associated land for the agricultural operation which they retained a stake within.
